High Court in Belfast to Rule on Same-Sex Marriage Today

A High Court in Belfast will return a verdict on same-sex marriage in Northern Ireland later today.

Northern Ireland remains the only part of the United Kingdom without an equal marriage law.

It does not recognise overseas gay marriages, either, including those legally made in Scotland, England and Wales.

There are two gay marriage cases under consideration:

  • Case number one is concerned with the right of same-sex couples to marry. Those bringing the action to court argue that a ban is discriminatory and undermines the human rights of same-sex couples.

  • Case number two concerns the lack of recognition for gay couples who have married overseas.  The couple bringing the case to court married in England but now live in Northern Ireland where, under local law, they are only classed as civil partners.

The judge, Mr Justice O’Hara, has spent two years reviewing the cases.

Victory, in either, would be a step forward for the LGBT community.

The judge could, however, rule against both cases in which case the issue of same-sex marriage will revert back to Parliament.

And of course, that means getting it past the DUP.

We’ll keep you updated.
